Compound Fines and Warning Notices Issued for Sale of Telecommunications Equipment and Operation of Radio-communications Equipment Without Valid Licences
The Authority for Info-communications Technology Industry of Brunei Darussalam (AITI) issued compound fines and warning notices to five (5) businesses for the sale of telecommunications equipment and operation of walkie-talkies without proof of necessary licences and approvals.
One (1) business was found in violation of section 34(1) of the Telecommunications Order, 2001 for offering for sale telecommunications equipment without a valid Dealer’s Licence, and section 35(1) of the Telecommunications Order, 2001 for operating walkie-talkies without the required licence. This business was issued two (2) compound fines amounting to Brunei Dollars One Thousand Four Hundred Only (BND1,400.00).
Three (3) other businesses were found to be operating walkie-talkies without a licence, thus contravening section 35(1) of the Telecommunications Order, 2001. The businesses were issued a compound fine of Brunei Dollars Seven Hundred (BND700.00) each.
All five (5) businesses were issued warning notices for failure to obtain the necessary type approvals from AITI pursuant to section 9 of the Telecommunications Order, 2001.
AITI would like to remind the public that unlicensed telecommunications systems and services may cause interference to critical infrastructure and essential services, potentially disrupting the operations of government agencies, local service providers, educational institutions and businesses that rely on telecommunications. The public is advised to seek AITI’s guidance and approval prior to installing any telecommunications system, providing telecommunications services, or operating any telecommunications or radio-communications equipment.
Businesses and the general public are encouraged to obtain the relevant licences for the establishment, installation, maintenance, provision or operation of any telecommunications or radio-communications system or service through AITI’s Online Services portal at https://online.aiti.gov.bn. Members of the public can also assist AITI in its efforts to curb any unlicensed activity by lodging a complaint to enforcement@aiti.gov.bn.
Pihak Berkuasa Industri Teknologi Info-komunikasi Negara Brunei Darussalam (AITI) mengeluarkan denda kompaun dan notis amaran kepada lima (5) syarikat kerana penjualan peralatan telekomunikasi dan penggunaan walkie-talkie tanpa bukti lesen yang sah dan kebenaran kelengkapan yang diperlukan.
Satu (1) syarikat didapati melanggar seksyen 34(1) Perintah Telekomunikasi, 2001 kerana menawarkan untuk jualan sebarang kelengkapan telekomunikasi tanpa lesen penjual yang sah, dan seksyen 35(1) Perintah Telekomunikasi, 2001 kerana mengendalikan kelengkapan radio-komunikasi, iaitu walkie-talkie, tanpa lessen yang diperlukan. Syarikat tersebut telah dikenakan dua (2) denda kompaun berjumlah Seribu Empat Ratus Ringgit Brunei (BND1,400.00).
Tiga (3) syarikat lain didapati melanggar seksyen 35(1) Perintah Telekomunikasi, 2001 kerana mengendalikan kelengkapan radio-komunikasi, iaitu walkie-talkie tanpa lesen. Ketiga-tiga syarikat tersebut telah dikenakan denda kompaun sebanyak Tujuh Ratus Ringgit Brunei (BND700.00) setiap satu.
Kesemua lima (5) syarikat telah diberikan notis amaran kerana gagal mendapatkan kebenaran kelengkapan yang diperlukan daripada AITI menurut seksyen 9 Perintah Telekomunikasi, 2001.
AITI ingin mengingatkan orang ramai bahawa sistem dan perkhidmatan telekomunikasi tidak berlesen boleh menyebabkan gangguan kepada infrastruktur kritikal dan perkhidmatan penting, yang boleh mengganggu operasi harian agensi Kerajaan, penyedia-penyedia perkhidmatan tempatan, institusi-institusi pendidikan dan perniagaan-perniagaan yang bergantung kepada telekomunikasi. Orang ramai dinasihatkan untuk mendapatkan nasihat dan kebenaran AITI sebelum memasang mana-mana sistem telekomunikasi, menyediakan sebarang perkhidmatan telekomunikasi atau mengendalikan sebarang peralatan telekomunikasi atau radio-komunikasi.
Para peniaga dan orang awam digalakkan untuk mendapatkan lesen yang berkaitan untuk penubuhan, pemasangan, penyelenggaraan, penyediaan atau pengendalian mana-mana sistem atau perkhidmatan telekomunikasi atau radio-komunikasi melalui AITI’s Online Services portal di https://online.aiti.gov.bn. Orang ramai juga boleh membantu AITI dalam usaha membendung sebarang aktiviti yang tidak berlesen dengan membuat aduan kepada enforcement@aiti.gov.bn.
